Ownership Transfer (Due to a Death)

The documentation required when ownership needs to be transferred because of a death.

The documents needed differ if there is or is not a will.


A will is available

When transferring the ownership of your mineral rights using the online portal due to a death and have a will, you will need to upload some documentation for the operator to review. Please provide the documentation below:

  • Death certificate

  • Letters of testamentary

  • Copy of the Last Will & Testament

  • Order Admitting Will to probate

  • Recorded final decree of distribution recorded in the county/parish where the property is located

  • W-9 form for each heir

Please note: This is if you do have a will in your possession. If there is no will, you will need to submit different documentation (see below).


No will is available

When transferring the ownership of your your mineral rights using the online portal due to a death and there is no will, you will need to upload some documentation for the operator to review. Please provide the documentation below:

  • Death certificate

  • Notarized and recorded copy of Affidavit of Heirship Form

  • W-9 form for each heir

Please note: This is if you do have not a will in your possession. If there is a will, you will need to submit different documentation (see above).
