Checks - Key Policies & Timing
Why amounts vary: market conditions, suspended payments, adjustments (over/underpayments), commodity prices, regulatory/contractual changes, production volumes, seasonal/maintenance effects.
Anticipating monthly amount: varies for reasons above.
Decimal interest differences (division order vs check detail): may vary due to special marketing, unit calculations, or other agreements; proportional value remains correct.
Adjustments: prior revenue may be reversed and repaid due to corrected volumes/pricing, allocation corrections, updated title information (DOI), or tax rate changes.
Payment timing: Oil & gas proceeds paid per Texas Natural Resources Code § 91.402, unless contract says otherwise.
Lost/not received check: Paper checks sent via USPS; allow up to 21 days before requesting void. Submit “Request to Void a Check” form; after processing, revenue is included in Surge’s next monthly check run.
Monthly check run: 25th of each month; if weekend/holiday, next business day.
Paper checks: USPS; allow up to 21 days before void request.
Direct Deposit: deposited on the 25th or next business day if weekend/holiday.
Ownership - Title & Suspense
Title requirements / clearing title: Operator searches county records and works with title attorneys to ensure payments comply with Texas title standards; gathering required documents from owners to meet standards is “clearing title.”
Suspended payments: may occur for missing Tax ID, insufficient address, assignment of interest, death notice, lack of documentation/title confirming ownership, or legal/title dispute.
Division orders: Surge uses the Texas Statutory Division Order (Texas Natural Resources Code § 91.402); requires a signed division order on file prior to payment unless otherwise specified in contract.
NPRI effect: Non-Participating Royalty Interests can affect your interest depending on ratifications; interest may fluctuate positively or negatively during ratification.
